By engaging Lextronics Audio for any services, purchasing products, or using our website, you agree to be bound by these Terms and Conditions. These terms constitute a legally binding agreement between you and Lextronics Audio.

If you do not agree to these terms, please do not use our services or make any purchases. We reserve the right to modify these terms at any time, and continued use of our services constitutes acceptance of any changes.

Important: These terms apply to all customers, whether residential, commercial, or institutional clients.

2. Services Provided

Lextronics Audio provides comprehensive audio and visual solutions, including but not limited to:

  • Audio Systems: Design, installation, and maintenance of sound systems
  • Visual Solutions: Display systems, projectors, and video conferencing setup
  • Home Theater: Complete entertainment system design and installation
  • Commercial AV: Business presentation and communication systems
  • Consultation: System design, planning, and technical advisory services
  • Support: Ongoing maintenance, troubleshooting, and system updates

Service Scope

All services are provided according to agreed specifications in written quotes or contracts. Any changes to the scope of work must be approved in writing and may result in additional charges.

3. Pricing and Payment Terms

Our pricing structure is designed to be transparent and fair for all clients:

Quotes and Estimates

  • All quotes are valid for 30 days unless otherwise specified
  • Prices may vary based on equipment availability and market conditions
  • Custom installations require detailed site assessment before final pricing
  • Additional charges may apply for expedited service or after-hours work

Payment Schedule

  • Deposit: 50% deposit required to begin work on projects over $1,000
  • Progress Payments: May be required for large installations
  • Final Payment: Due upon completion and customer acceptance
  • Service Calls: Payment due at time of service

Accepted Payment Methods

  • Cash, check, or electronic transfer
  • Major credit cards (Visa, MasterCard, American Express)
  • Net 30 terms available for approved commercial accounts

Late Payment: Accounts past due may be subject to a 1.5% monthly service charge and suspension of warranty services.

4. Installation and Delivery

Professional installation and timely delivery are core to our service commitment:

Installation Process

  • Site Preparation: Customer responsible for providing clear access and adequate power
  • Scheduling: Installation dates scheduled upon deposit receipt
  • Timeline: Estimated completion times provided, subject to equipment availability
  • Testing: All systems tested and demonstrated upon completion

Customer Responsibilities

  • Provide safe and unobstructed access to installation areas
  • Ensure adequate electrical power and internet connectivity as required
  • Protect personal property during installation
  • Be available for system demonstration and training

Delivery Terms

  • Standard delivery within Calgary metropolitan area included
  • Remote locations may incur additional delivery charges
  • Customer must inspect delivered equipment within 48 hours
  • Damage claims must be reported immediately upon delivery

5. Warranties and Guarantees

We stand behind our work and the products we install:

Service Warranty

  • Installation Work: 1-year warranty on all installation labor
  • System Programming: 90-day warranty on custom programming and configuration
  • Troubleshooting: 30-day warranty on service call repairs

Equipment Warranty

  • All equipment covered by manufacturer's warranty
  • Lextronics Audio facilitates warranty claims and repairs
  • Extended warranty options available for most products
  • Warranty void if equipment is modified by unauthorized parties

Warranty Exclusions

  • Damage due to misuse, abuse, or environmental factors
  • Normal wear and tear of equipment
  • Damage from power surges (surge protection recommended)
  • Software updates or compatibility issues with third-party devices

Warranty Service: Contact us immediately if you experience any issues. Prompt reporting ensures the best resolution and maintains warranty coverage.

6. Limitation of Liability

While we strive for excellence, certain limitations apply to our liability:

Service Limitations

  • Our liability is limited to the cost of services provided
  • We are not responsible for consequential or indirect damages
  • Customer assumes responsibility for data backup before service
  • We are not liable for compatibility issues with existing equipment not installed by us

Property Protection

  • We carry comprehensive liability insurance for property protection
  • Customer should secure valuable items during installation
  • Pre-existing damage should be noted before work begins
  • We are not responsible for damage to concealed utilities not marked

Force Majeure

We are not liable for delays or inability to perform due to circumstances beyond our control, including but not limited to natural disasters, supply chain disruptions, or government regulations.

7. Intellectual Property

Respect for intellectual property rights is fundamental to our business:

Our Intellectual Property

  • Custom system designs and configurations remain our intellectual property
  • Programming and software customizations are licensed, not sold
  • Documentation and training materials are for customer use only
  • Lextronics Audio name and logo are protected trademarks

Third-Party Rights

  • All manufacturer software and firmware remain property of respective owners
  • Customer responsible for obtaining proper licensing for content and software
  • We do not provide or support unauthorized software or content

8. Cancellation and Refund Policy

We understand that circumstances can change, and we strive to be fair in our cancellation policies:

Project Cancellation

  • Before Work Begins: Full refund minus 10% administrative fee
  • After Work Begins: Refund of unused portion minus completed work and restocking fees
  • Custom Orders: Non-refundable once equipment is ordered
  • Installation Day: Cancellation fee of $200 if cancelled within 24 hours

Service Call Cancellation

  • No charge if cancelled more than 4 hours in advance
  • $75 cancellation fee if cancelled within 4 hours
  • Full service charge if technician arrives and customer unavailable

Equipment Returns

  • Unopened equipment may be returned within 15 days
  • 25% restocking fee applies to all returns
  • Custom or special-order items are non-returnable
  • Customer responsible for return shipping costs

9. Privacy and Data Protection

System Access

  • We may require network access for system setup and maintenance
  • Customer data and network security remain customer responsibility
  • We do not access or store personal files or data
  • Remote access capabilities are disabled after service completion unless requested

  • Management Review: Unresolved issues escalated to management
  • Mediation: Third-party mediation available for complex disputes

Any claims must be brought within one year of the completion of services or delivery of equipment.

11. General Provisions

These terms are governed by the laws of Alberta, Canada, and any disputes will be resolved in Calgary, Alberta courts.

Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement

These terms, along with any written quotes or contracts, constitute the entire agreement between you and Lextronics Audio.
